Dear Ingrid,
Thank you for setting out your questions so clearly. My answers are below, numbered as in your email and written so that each one can be read on its own. Where something is not yet in place, I say so and give the date. Grace Oduya, our General Counsel (copied), will answer question 5 separately by 10:00 Oslo time on Wednesday, 21 October.
In short: Meridian would receive operational data about API requests, with no card data, names or transaction amounts, for the sole purpose of detecting regional outages. None of your production traffic reaches Meridian before 16 November, and none at all without your written consent.
For a 1% sample of your API requests, plus every request that returns a server error: your merchant ID, region, timestamp, response time, status code, and the source IP address, shortened before it leaves our systems (the last octet removed for IPv4; everything after the first 48 bits for IPv6). Card data, cardholder names, email addresses and transaction amounts are not included; those fields do not exist in the telemetry format. Status: the shortening has run in our test environment since 14 October and goes to production on 6 November. Whether shortened IP addresses are personal data is for you and your counsel to assess; I have described them as precisely as I can so that you can.
Meridian may use the data only to provide its monitoring service to Anchorpoint. It may not use it to train models or improve its products, in de-identified form or otherwise. Status: Meridian confirmed this in writing on 16 October. The amendment to our data processing agreement with Meridian is due for signature by 23 October, and I will tell you on the day it is signed.
According to Meridian's written statement, it processes and stores the data in Stockholm and Frankfurt. Raw records are deleted after 30 days; aggregated response-time figures, which contain no IP addresses, are kept for 13 months. If Meridian changes its own sub-processors, it must tell us 30 days in advance, and if you object, we can stop sending your data at no cost to you.
Yes, the change follows that incident. On 15 September, from 14:02 to 14:13 UTC, an automated failover was triggered by an incorrect external health signal; our primary region was operating normally. For Halvorsen, 1,840 of 306,000 API requests in that window (0.6%) returned errors, and 99th-percentile response time rose from 210 ms to 1.9 seconds. No data was lost, and both regions involved are in the EU. Meridian would give us a second, independent signal, so that no single signal can trigger a failover on its own.
Grace will reply to this directly, as noted above.
Nothing changes for you. If we do not have your written consent by Friday, 13 November, your traffic is left out of the sample sent to Meridian. Your service, pricing and SLA stay as they are, and the new safeguard still covers your traffic, using other customers' samples and our own synthetic checks. We settled this internally before the notices went out, so declining is a genuine option.
If it would help your Committee to hear any of this directly, I can join for ten minutes on 22 October.

|---|---|---|---|
| A. "No personal data is included."
| B. "Some personal data may be included." |
(3) Q5(責任)
|---|---|---|
| G. "Yes, we remain fully liable."
|---|---|---|---|
| J. "Dear Ms Sæther" |
|---|---|---|
| "We confirm that no personal data will be included." | 相手の求める形(confirm)で答え、法的評価を自分で下す | "Whether shortened IP addresses are personal data is for you and your counsel to assess." |
| "Meridian is contractually prohibited from using your data for AI training." | 未署名の DPA を署名済みのように書く | "Meridian confirmed this in writing on 16 October. The amendment ... is due for signature by 23 October." |
| "The incident on 15 September was minor and short." | 評価語で影響を小さく見せる | "1,840 of 306,000 API requests in that window (0.6%) returned errors." |
| "It was caused by a false alert from our cloud vendor's status API." | 承認済みの文言を言い換え、NDA の対象に触れる | "an automated failover was triggered by an incorrect external health signal" |
| "Regarding Q5, please ask our legal team." | 誰が・いつまでに、が無い | "Grace Oduya ... will answer question 5 separately by 10:00 Oslo time on Wednesday, 21 October." |
| "If you don't consent, the new protection will not be available for your traffic." ... the new safeguard still covers your traffic." |
| "As mentioned above, ..." |
| "We will reply by 12:00 CET on 21 October." | 夏時間の期間に CET と書く | "by 10:00 Oslo time" / "by 10:00 UTC" |
| "Please feel free to contact me if you have any questions." | 定型句で具体性が無い | "I can join for ten minutes on 22 October." |

- 発展: 10/21(水)09:15 UTC、Ingrid から "Thank you — very clear. One follow-up for the Committee: you say the shortening 'goes to production on 6 November'. What happens if that date slips? Would unshortened IPs be sent from 16 November?"
